Terms of Service

These Terms of Service ("Terms") govern your access to and use of websites, applications, educational tools, and research prototypes operated by Einbrain Lab ("we", "us", or "our"). These services include XR Nook, an educational and research virtual-human platform hosted at xrnook.com, its related applications TechNook (tech.xrnook.com), TeachNook (teach.vividta.com), and MedNook (medchat.clinicalnook.com), and AGSTEM Research Studio, which is hosted at agstem.vividta.com. By using our services, you agree to these Terms.

1. Permitted Use

You may use our services only for lawful, authorized, and intended educational, research, demonstration, or informational purposes. You agree not to:

• Use the services in violation of any law, regulation, institutional rule, or third-party right.
• Attempt to gain unauthorized access to accounts, systems, prompts, models, datasets, or administrative tools.
• Upload or transmit malicious code, spam, abusive material, or content intended to disrupt the service.
• Use the service to generate unlawful, deceptive, harmful, or infringing content.
• Reverse engineer, scrape, replicate, or misuse our systems except where permitted by law.

2. Accounts and Access

Some services require sign-in or invitation-based access. You are responsible for maintaining the confidentiality of your account and for activities that occur under it. We may suspend or revoke access if we believe use is unauthorized, unsafe, or inconsistent with these Terms.

3. AGSTEM Research Studio and User-Selected Google Docs

AGSTEM Research Studio provides experimental virtual-human learning, simulation, and research experiences. Where it offers Google Picker, you may select only Google Docs you are authorized to use. The selected document continues to be governed by its owner's Google sharing settings and Google's terms. You must not use another person's documents without permission or attempt to bypass account, document, or service security controls.

4. AI-Generated Content

Some Einbrain Lab services use AI systems to generate responses, simulations, feedback, summaries, or recommendations. AI output may be incomplete, inaccurate, or unsuitable for a given purpose. You are responsible for reviewing outputs before relying on them, especially in academic, medical, legal, professional, or safety-sensitive contexts.

5. Research and Educational Context

Many Einbrain Lab services are experimental, instructional, or research-oriented. Features may change, be limited, or be discontinued. Additional project-specific rules, consent language, or institutional requirements may apply to a specific study or deployment.

6. Conversation Logging and Voice Input

Conversations with our virtual characters are recorded. When you use XR Nook, TechNook, TeachNook, MedNook, or AGSTEM Research Studio, the text of your messages and of the characters' replies is stored in our research databases, together with technical details of each exchange. If you use the microphone control, your speech is recorded briefly and converted to text; the text is stored and the audio is not kept. These records are held in a Google Cloud project administered under Texas A&M University's Google Cloud environment and are used for the lab's educational and research work. Our Privacy Policy describes this in detail. By using these applications you acknowledge that your conversations are recorded for the educational and research purposes described there.

You agree not to enter names, contact details, health information, student records, or other personal or confidential information about yourself or anyone else into a conversation. The characters are simulations for practice and rehearsal. They do not provide medical, clinical, legal, or other professional advice, and MedNook in particular is an educational simulation rather than patient care.

7. Privacy

Your use of our services is also governed by our Privacy Policy.

8. Intellectual Property

Unless otherwise stated, the services, software, interfaces, branding, designs, and related materials are owned by or licensed to Einbrain Lab and are protected by applicable intellectual property laws. These Terms do not grant you ownership of our services or content.

9. Third-Party Services

Our services may rely on third-party platforms, APIs, or authentication providers, including Google, Firebase, and Google Cloud services such as Vertex AI, Speech-to-Text, and Text-to-Speech. Your use of those third-party services may also be subject to their own terms and policies.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or reliability.

11. Limitation of Liability

To the fullest extent permitted by law, Einbrain Lab will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or opportunities arising from or related to your use of the services.

12. Termination

We may suspend, restrict, or terminate access to a service at any time, including when needed for maintenance, security, research controls, institutional requirements, or Terms enforcement.

13. Changes to These Terms

We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use after changes take effect constitutes acceptance of the revised Terms.
